Information on public aid/de minimis aid

Public aid and de minimis aid for eligible recipients who are micro, small or medium-sized enterprises due to the maximum price applied by VECP in the second half of 2024.

1. Public aid and de minimis aid in respect of the applicable maximum price for eligible recipients.

In accordance with the Energy Voucher Act1 maximum price (PLN 0,698 net/kWh) applicable in the period from July 1 to December 31, 2024. in relation to the entrepreneur, referred to in Article 2, point 2, letter b and c of the Act on Extraordinary Measures2:

a) being a small or medium-sized enterprise constitutes de minimis aid3

b) being a micro-enterprise constitutes public aid4 .

This means that eligible customers who are microenterprises, small or medium-sized enterprises, for which Veolia Energy Contracting Poland sp. z o. o. (hereinafter "VECP") applied maximum prices in electricity settlements in the period from 1 July 2024 to 31 December 2024, are obliged to submit to VECP, as the entity granting aid, information on the amount of de minimis aid, de minimis aid in agriculture, de minimis aid in fisheries or public aid received.

2. The method and deadline within which eligible recipients are obliged to submit information on granted public aid or de minimis aid.

In order to fulfil the obligation to provide the VECP with information on the amount of de minimis aid, de minimis aid in agriculture, de minimis aid in fisheries or public aid received, the eligible recipient should complete the form "Information on public aid granted" and submit it to the VECP by the deadline until 30.06.2025.

In the "Information on granted public aid" the amount of aid obtained should be indicated excluding aid resulting from the application of maximum electricity prices in the second half of 2024. Please indicate only assistance obtained from other sources during the 3-year period.

“Information on granted public aid” should be submitted on the form published by the Minister of Climate and Environment in the Public Information Bulletin.

3. The form of submitting the "Information on the public aid granted" form

An eligible recipient who is a micro, small or medium-sized enterprise may submit the “Information on public aid granted” form:

a) in electronic form, provided with a qualified electronic signature or a trusted signature (ePUAP signature) or a personal signature confirmed by an identity card with an electronic layer (eDowod).

4. Consequences of the recipient's failure to fulfil the obligation to provide the VECP with "Information on the state aid granted".

In the event of failure to provide the VECP with the “Information on the public aid granted” (or providing it after the deadline) and also in the event that the “Information on the public aid granted” indicates that the eligible recipient has exceeded the permissible public aid, the eligible recipient who benefited from the maximum prices in the second half of 2024,  will be obliged to return, with interest, the difference between the maximum price and the price resulting from the electricity sales agreement concluded with VECP.

The refund will be made as part of electricity settlements in subsequent settlement periods, and in the absence of an electricity sales agreement with VECP, the recipient will be obliged to make the refund to the bank account indicated by VECP within 14 days of receiving the request.

 

5. Additional information

The amount of permissible de minimis aid for small and medium-sized enterprises is regulated in the following regulations:

a) Commission Regulation (EU) 2023/2831 of 13 December 2023 on the application of Articles 107 and 108 of the Treaty on the Functioning of the European Union to de minimis aid (OJ EU L 2023, item 2831).

b) Commission Regulation (EU) No 1408/2013 [of 18 December 2013 on the application of Articles 107 and 108 of the Treaty on the Functioning of the European Union to de minimis aid in the agriculture sector (OJ EU L 2013, 352, No 9, p. XNUMX, as amended].

c) Commission Regulation (EU) No 717/2014 of 27 June 2014 on the application of Articles 107 and 108 of the Treaty on the Functioning of the European Union to de minimis aid in the fishery and aquaculture sector (OJ EU L 2014, 190, No 45, p. XNUMX, as amended).

d) Act of 30 April 2004 on procedure in matters concerning state aid.

VECP does not provide and is not authorized to provide information on the limits of de minimis aid, the amount of public aid or de minimis aid received by the eligible recipient, or on the method of completing and the content of the “Information on granted public aid” form.
